Pools:
Most homebuyers are chiefly concerned with liners and
equipment and may not ascertain whether the pool area
meets municipal fencing and property-line bylaws or
whether it is located near existing easements. Pools
and equipment included in home sales should be examined
for defects (even in the winter) and include contract
clauses warranting their condition. All homeowners are
advised to check with their local government to determine
whether their pool meets regulatory codes.
Ponds:
A defective circulating pump or leaking pond liner can
cost thousands to replace, and yet pond equipment is
rarely discussed during home purchases. Some municipalities
have fencing regulations governing deep ponds. Homeowners
would be well advised to study these regulations before
installing a pond or before buying a home with such
a pond. Most Canadian and British municipalities surveyed
do not have clear regulations on fencing around ponds,
but that may not nullify an owner's liability in the
event of a mishap.
